A case was brought before the Vanderburgh County court system recently by the lawyers of Bill Musgrave.
Musgrave claimed that the aluminum producer Alcoa played an integral role in the cause of a rare form of liver cancer he contracted after years of working in the mine that was near the chemical dump site of Alcoa.
The Vanderburgh County jury sided with the aluminum producer, saving Alcoa the $12million settlement filed by the former miner.
Alcoa’s lawyers told the court that the suit was filed after the statute of limitations and that even Musgrave’s doctors couldn’t prove the link between the dumped chemicals and Musgrave’s rare form of cancer.
Unfortunately, Musgrave will not receive the settlement he likely deserved in this case. It seems likely that working in such proximity to hazardous waste and chemical dump sites for so many years would have played a factor in his aggressive form of liver cancer. A man was killed on Wednesday morning when he drove his truck into construction equipment that was parked in a construction zone in the 6600 block of Grandview Drive in downtown Indianapolis.
According to the police report, the accident happened shortly before 3:00am when the truck was headed South on Grandview dr.
A rescue team from the fire department found the man inside the burning truck. He was pronounced dead on site.
A coroner is still working to identify the man so his family can be notified. Police say the man looked to be either white or Hispanic, and possibly in his 20’s.
Because this was a construction site accident, it is possible that more road closures will be necessary during the investigation of the crash. However, no more closures are scheduled or expected at this time.
The cause of the crash has yet to be determined, although police suspect that alcohol may have been involved. As the investigation is ongoing, authorities will determine whether the accident was caused by alcohol or if it could have been related to misplacement of construction equipment or somehow the fault of the construction company. Thankfully, no workers were injured during this crash.

An Indianapolis man was nearly drowned this week when he lost control of his tractor and landed in a retention pond in the Hancock County community of New Palestine.
Oren Killebrew, 23, was doing landscaping work at the Seifert Creek Homes neighborhood, and was attempting to remove a tree when his tractor rolled and flipped into the pond. Killebrew was pinned under the water, according to the Indiana Department of Natural Resources. According to witnesses, the tractor began backing toward the pond and ran into a dock, causing the tractor to flip onto its left side. Killebrew tried to jump off of the tractor rollover, but he was pinned underneath the left rear tire.
Killebrew was given emergency aid and then was taken to New Palestine High School. From there he was flown by helicopter to St. Vincent Hospital where he died later that day.
The incident is under further investigation by the Conservation Officer, Bo Spainhour, the New Palestine Police Department, and the Hancock County Sheriff’s Department.
