Prescription Medications

Obtaining Medications for Injured Workers

If you have suffered a serious injury, you may require continuing medication — perhaps for life. During the course of your claim, the work comp insurer is supposed to issue you a prescription card or at least reimburse you for the cost of all prescriptions. Too often this simply does not happen. At our Carmel, Indiana, law firm, Wagner Reese & Crossen, our attorneys are dedicated to making sure that injured workers obtain full benefits, including payment for ongoing prescription medications.

Many injured workers need medication after they have returned to work

Known as one of the leading workers’ comp law firms in the state, we have handled thousands of workers’ compensation cases since 1997. Our lawyers know from this experience that many people who have suffered on-the-job injuries need pain medication, muscle relaxants, anti-depressants and other prescriptions. Many people do not have health insurance that might pay when the workers’ compensation system does not. In order to get needed medications, an injured worker may have to fight the insurance carrier and the employer. Even if the Indiana Workers’ Compensation Board has ordered payment for medication, the employer and insurance company may stop paying if they get a physician to say the medications are no longer needed. That’s where we can help. Contact us to discuss any question or issue related to medication in a workers’ comp claim. Call today for a free initial consultation.

Problems with payment for medication may come up after the employee has returned to work

We advise our clients to keep all pharmacy receipts and record their expenses. These expenses can include transportation and mileage to get to the pharmacy as well as delivery costs. The workers’ comp insurance company may also provide a pharmacy card to be used during the active treatment phase of the case. Problems with medications often arise only after the employee has returned to work and is no longer under a doctor’s active care. Many work comp doctors simply tell the injured worker, “You will need to see your family physician for all future prescriptions.”
